Lawyers for a Rockhampton criminal solicitor facing choking and assault charges wants to see the brief of evidence for fresh charges before moving the case forward, a District Court has heard.

Jack Anthony Blackburn, 35, has been charged with two counts of choking and two of common assault.

The court heard he had fresh charges mentioned in Rockhampton Magistrates Court recently.

Legal Aid solicitor Mr Schafer advised Rockhampton District Court, where the choking and assault charges are currently listed, that Mr Blackburn’s defence team wanted to view the brief of evidence for the news charges in the lower court before determining what would happen next for the current charges.

During the bail application in April 2022, the court heard the allegations involved Mr Blackburn allegedly choking the alleged victim twice on March 20 and threatening to put a large wooden pencil through her windpipe.

It is alleged the first choking incident was with his hands around the alleged victim’s neck, making it hard for her to swallow and breath and causing her vision to blur.

It is alleged he also wrapped an arm around the woman’s neck from behind and applied pressure, causing difficulty breathing.

Mr Blackburn is also alleged to have dug his knuckle into the alleged victim’s lower spine, which caused her to drop to the ground.

It was also alleged Mr Blackburn and the alleged victim were at a park in the Rockhampton region on April 2 where he allegedly made threats of suicide by police and to harm other persons, causing the alleged victim stress.

Mr Blackburn’s District Court matters were adjourned to September 22 and the court also heard his matters in the magistrates court jurisdiction were adjourned until August 9.

His bail was enlarged.
