Drinks with colleagues before dining out for his partner’s birthday led to a public drunken fight and a hefty fine.

Drinks with colleagues before dining out for his partner’s birthday led to a public drunken fight and a hefty fine.

Matthew Brendan Lobban, 47, pleaded guilty on August 13 in Rockhampton Magistrates Court to one count of public nuisance in licenced premise and one of obstruct police in a public place while intoxicated.

Three security guards working at The Bavarian in Rockhampton, and an assistant manager, witnessed or were involved in Lobban’s offending.

Police prosecutor Brandy Butler said Lobban he was seated at a table inside the restaurant about 7.20pm on November 28, before he exited through the front entrance.

“(Lobban) involved himself in a fight in progress between his associate and two security guards who were attempting to remove his co-offender from the premises,” Ms Butler said.

She said Lobban approached the first security guard, swung his right arm around the guard’s torso and pushed the guard to the ground, causing him to fall backwards into another security guard.

“The fight has continued into the carpark and progressed to the left side of the front entrance,” Ms Butler said.

“The co-offender and another security guard have held onto each other.”

She said a third security guard became involved in the fight, pulling the co-offender away from a security guard and Lobban grabbed the third guard from behind, pushing him into a parked car and then thrown him to the ground.

The first guard Lobban attacked came to assist the guard on the ground near the car, Lobban then grabbed the first guard by the collar of his shirt and the guard grabbed onto Lobban.

Lobban then pushed the first guard into the parked car.

The third security guard approached the fight as the co-offender pushed a security guard up against a parked car and attempted to pull the co-offender away from the security guard he had ahold of.

Lobban approached the third guard from behind and grabbed him by the shoulders and pushed him up against a parked car.

Lobban then walked away from the venue and into the car park.

Police were speaking with staff when Lobban has approached and attempted to regain entry into The Bavarian.

Various staff identified Lobban as one of the men involved in the fight.

He was intoxicated and slurring his speech.

Ms Butler said when police told Lobban he was under arrest, he yelled over the top of them “I paid for this. I need to drink this beer. I don’t give a f-- what you are trying to tell me.”

Defence lawyer Jodi Brown said Lobban had been drinking with colleagues and then went out for dinner for his partner’s birthday.

She said Lobban’s partner of 17 years was not impressed with this.

Ms Brown said Lobban’s nephew got into a fight with security.

She said when police advised him he was under arrest, Lobban was confused.

Ms Brown said at the time, Lobban had been working 60-70 hours per week and was under some stress.

She said since the incident, the soon-to-be grandfather had reduced his alcohol consumption and this behaviour was unlike him.

Magistrate Cameron Press said this was quite appalling behaviour that took place in public and likely in front of children.

He ordered Lobban, who had no criminal record, to pay a $1400 fine with no convictions recorded.
