Jett Building and Construction liquidation: Full list of 90 creditors totalling $3.08 million

From painting businesses to office furniture, industrial supplies and insurance, the list of companies owed money in the fallout of Yeppoon-based company Jett Building and Construction (JBC) going into liquidation is exhaustive and astronomical.

The company was formally placed into liquidation on Monday (September 27), with Michael Beck and Morgan Lane of Worrells Solvency and Forensic Accountants appointed as liquidators.

It was initially reported the company owed about $1.9 million.

This publication has obtained a list of 90 creditors that claim JBC owes $3,081,948.73.

The full list of creditors is at the end of this article.

The two largest sums are for Gracemere based Amcor Quarries and Concrete Pty Ltd ($807,171.62) and Australian Taxation Office Insolvency ($1,180,088).

Worrells previously reported JBC was owed about $2.5 million, for works it carried out at Shoalwater Bay Training Area, by Downer FKG.

Joint venture Downer and FKG was granted a $135 million managing contract in March 2020 for the remediation project at the site 80kms north of Rockhampton.

The project scope includes a new 1,000 troop urban operations training facility, field hospital site and military campsite, upgrades and remediation to an airfield, internal roads, creek crossings and beach landing sites with the establishment and operation of two construction camps to support the works.

“We understand that the non and delayed payment on this project resulted in the liquidation of the company,” Worrells Rockhampton partner Michael Beck said.

Downer responded to this publication’s request for comment three days later and claimed JBC “has been paid in full for all the work it has completed on the project to date”.

JBC director Brett Dixon said “he was owed millions of dollars by DFKG for unpaid claims and variations of the Australian Defence Project at Shoalwater Bay and receipt of these moneys would have seen these creditors paid”.

“The final decision to place the company into liquidation comes after many months of dealing with DFKG staff who made promises of payment, while still requesting us to undertake additional works,” he said.

“Unfortunately, the payments never came, while we continued to complete works so that DFKG reached their targets.”

Mr Dixon also claimed more contractors could be forced into liquidation over the situation.

“The actions of DFKG are continuing today with other contractors owed thousands of dollars also and they too may be forced into liquidation due to non-payment,” he said.

While it is a Defence project, the department has washed its hands of any responsibility and has only provided a one-line statement on the matter.

“JBC were engaged by the managing contractor, Downer/FKG as a subcontractor on the Shoalwater Bay Training Area Remediation Project. Defence has no direct contractual relationship with JBC,” the Defence statement read.

At the time of liquidation JBC had 15 permanent staff and 14 casuals, who have all now been made redundant.

Worrells is calling for all creditors to lodge a proof of debt via its online portal at www.worrells.net.au.

The Queensland Building and Construction Commission said that as of Thursday (September 30), it had not received any monies-owed complaints from Jett Building and Construction Pty Ltd.

“It is a condition of holding a QBCC licence that a licensee pays their debts as and when they fall due, or else face regulatory action against their licence, ranging from conditions being applied, to suspension or cancellation,” the QBCC statement said.

“The Building Industry Fairness (Security of Payment) Act 2017 was introduced to help to ensure a fairer building and construction industry where people are paid in full, on time, every time.

“The QBCC-administered adjudication process is an important part of that Act and is available to parties in a disputed debt for construction work in Queensland.

“Parties in dispute should contact the QBCC Adjudication Registry to see if adjudication is applicable and appropriate for them.”
