Unbeknown to her Shane Edwin Aughey had crept into the Victoria Plains home, disguised in a balaclava, and unleashed a relentless wave of violence on the 53 year old.


Mackay District Court heard there had previously been a strong friendship between Aughey and the couple – the 39 year old had lived at their property in 2018 and 2019.

But Crown prosecutor Nicole Friedewald said there was a falling out.

Aughey had wrongly believed the couple had stolen some of his belongings.

He pleaded guilty to burglary and assault occasioning bodily harm, and was sentenced to 2.5 years jail.

Chantelle Louise Emslie

A distraught Chantelle Louise Emslie could be heard telling her legal team “I can’t go in [to jail]” as the reality of her sentence sunk in at Mackay District Court on August 27, 2021.

The court heard Emslie and co-offender Vicky-Marie Philippi robbed a female backpacker in her Airlie Beach hostel room in June 2020 because Emslie believed the woman owed her $400.

Crown prosecutor Samantha O‘Rourke told the court Philippi and others egged Emslie on to find the backpacker and “get her money back”, before the pair went to the hostel on June 7, 2020, with Emslie wielding a hammer and knuckle dusters and threatening the woman with further violence if she went to police.

Judge Tony Moynihan noted co-offender Philippi had been sentenced to two years and nine months’ jail for her role in the robbery.

Emslie pleaded guilty to burglary and armed robbery, in company, with personal violence.

She was sentenced in August to two years and nine months’ jail but got a parole release date of February 26, 2022, meaning she would likely only serve about six months in custody.

Vicki-Marie Phillipi

A woman was jailed for her role in a burglary at an Airlie Beach backpackers hostel that involved a hammer and knuckle dusters.

The court heard a woman was staying in Airlie Beach in June 2020 when Vicki-Marie Phillipi and Chantelle Louise Emslie entered the room, closing the door behind them.

The mother-of-two pleaded guilty in Mackay District Court to burglary and possessing property suspected of having been used in connection with the commission of a drug offence.

Phillipi was sentenced to two years and nine months in jail, with parole in November, 2021.

Mark Brenton Payne

A man who threatened to “melt off” his former partner’s face with caustic soda before turning up at her home brandishing a loaded gun was jailed for the offending.

Mark Brenton Payne, 28, fired two warning shots in front of the woman and her two-year-old daughter after he broke into her Mackay home in October 2019.

Prosecutor Ben Jackson said the pair, who had broken up after a nine-month relationship, had been texting earlier that day, when Payne wrote “now you’re going to see why you should show me respect, I tried being nice, now you asked for this”.

Mr Jackson said that earlier in their relationship Payne had “threatened to melt (her) face off with caustic soda” while under the influence of drugs.

The woman was at her Andergrove home with her brother and his friends when Payne arrived later that evening and loudly bashed on the front door before breaking in through the back door.

While waving the gun around Payne yelled at the woman and knocked over a saucepan with teriyaki sauce which splashed in her eye.

When the woman began yelling Payne said, “this is how much I don’t give a f***” and fired two shots outside before fleeing the scene.

The court heard the two-year-old girl was metres away on the couch at the time and her mother still has nightmares and “wakes up crying” when she hears loud noises.

He pleaded guilty to multiple charges including burglary and threatening violence, aggravated possession of a category H weapon, possessing a category H and category D weapon, possessing drugs and utensils.

Payne was sentenced to five years’ jail.

Jason Michael Hayes

Three children watched as a man gripped their mother by her throat during a violent home invasion in Mackay.

She was Jason Michael Hayes‘ former partner, but the pair had split for good mid-last year.

On October 24, 2018 he sent his former partner an abusive text message “out of the blue” at 3.44pm, sparking a violent confrontation barely three hours later at her home.

Crown prosecutor Gavin Webber said the woman tried to stop him, but Hayes knocked her to the ground, fracturing her wrist as he pushed his way inside the house.

Drunk and in a rage, he then grabbed her by the throat with both hands as her three children, two of whom were his, witnessed the attack.

The 33-year-old pleaded guilty to burglary with violence and assault occasioning bodily harm.

He received a jail term of 15 months with parole eligibility in September 2019.

Sonny Mooney

The uncle of a popular Mackay teen tragically killed in a shocking hit and run at Beaconsfield unleashed a violent home invasion against an innocent man, who he believed was linked to her death.

Nilly Mooney was struck and killed as she searched for her phone on Nicklin Drive about 3pm on March 1, 2020.

Defence barrister Scott Moon told Mackay District Court that at the time “my client’s view was that she (Nilly) was murdered”.

No one was charged with murder over the 15 year old’s death.

The driver of the vehicle, Jessica May Goulding, later pleaded guilty to failing to remain at the scene and render assistance over the harrowing incident.

She was jailed for three years, to serve 12 months.

On June 22, 2020, Sonny Mooney had been drinking a lot – a full bottle of 40 per cent vodka and 10-pack of premix bourbons – when he spotted the victim’s car and believed he was responsible.

So while armed with a knife he unleashed a violent home invasion at North Mackay.

He pleaded guilty to burglary with intent, two counts of assault occasioning bodily harm and stealing smokes and a lighter.

Mooney was jailed for three years with immediate parole release.

Convictions were recorded and the 395 days were declared time already served.

But the plan took a horrific turn, ending with a young father bleeding to death on the roadside after he drunkenly forced his way into a home and launched at a man armed with a knife for his protection.

A court heard Samantha-Renee Elizabeth Mackinlay recruited a group of youths, including her nephew Corey Verburg, Kobi Jackson Dunn and Jessi Kennedy, in a revenge plot against an Andergrove retiree over a baseless rumour.

Crown prosecutor Claudia Georgouras told the court that during the drive the group was texting and calling the victim, Stephen Johnson, “so he knew that they were coming”.

“Mr Verburg broke through the door while the (victim) was on the other side armed with a knife and he jumped onto the (victim) and he was stabbed,” Ms Georgouras said.

Mr Verburg, a 20-year-old father, later died on Glenpark St.

Dunn pleaded to aggravated burglary and was jailed for two years with immediate parole.

Kennedy pleaded guilty to the same charge and was jailed for 18 months with immediate parole.

Mackinlay, 33, pleaded guilty to aggravated burglary and wilful damage.

She was given immediate parole on a 2.5-year jail term.
