A young man asked for bail a day after he was allegedly caught “red-handed” by police attempting to flee over a fence from a house he burgled while on bail.

An 21-year-old man who police arrested for allegedly burgling a home while on bail then asked Mackay Magistrates Court the next day to apply for bail again.
Kristopher Reece John Potter was charged with stealing sunglasses and breaking in to a South Mackay house on March 7 after police were called to the premises.
A Mackay Police notice alleges the Andergrove man was found “climbing over the fence” at a home on Grant St at about 10.30pm before police arrested him.
Duty lawyer Rose Varley applied for bail on Mr Potter’s behalf, who watched from a watch-house video-link, stating he was “still a relatively young person” who had engaged with rehabilitation services like Lives Lived Well.
“I do concede it is a very strong Crown case … as per my instructions he was essentially caught red handed,” Ms Varley said.
She said bail could be accepted given his “limited” history for failing to appear at court, but Magistrate Damien Dwyer interrupted to mention the “three or four” previous charges for fail to appear.
Mr Dwyer said his difficulty with granting bail was Mr Potter’s “terrible history of property offences” similar to his conduct the night before.
“This is a serious property offence (and) it is an identical offence to what he was on bail for,” Mr Dwyer said.
The court heard Mr Potter had been on bail for nine other matters, including possessing dangerous drugs, trespassing, entering premises to commit offences, stealing, and unlawful use of a motor vehicle.
“In my view the evidence against you is strong and I’m not satisfied you’re not going to commit any further offences,” Mr Dwyer said.
Mr Potter was refused bail and his matters adjourned to March 14 for mention with his other charges.
