The disappearance of a vital report has delayed the alleged murder case against a man accused of shooting and killing a young Mackay mum.
Ryan Geoffrey Cole, 31, is charged with murdering 34-year-old Natalie Frahm on June 19, 2024 as she sat in her car in her driveway on Robb Place while two girls were in the vehicle with her.
He’s also charged with the attempted murder of James ‘Jimmy’ McGill, 66, who was nearby visiting his 89-year-old mother’s home at the time.
Police arrested Mr Cole at the Paget KFC/BP service station after a three-hour manhunt and he remains in custody on remand.
Michael Guest of Guest Lawyers told Mackay Magistrates Court during a brief mention he had engaged a medical professional to start an assessment of Mr Cole, but had not been provided with a critical toxicology report, which had disappeared.
“The toxicology report is going to be critical if that matter is referred to another jurisdiction for assessment,” Mr Guest said.
He said a toxicology analysis certificate was previously mentioned in an index brief, but now “there’s no reference to that toxicology”.
“It’s created a problem to me … because I can’t get the assessment completed until such a time as that toxicology analysis is provided to me,” Mr Guest said.
Acting magistrate Andrew Walker said the toxicology report was “in the index brief last year and now everything seems gone”.
QPS prosecutor Katarina Pollard briefly searched for mention of the report during the court mention, but could find none.
“If we do have it or if officers in that section are aware of it … if not I can get the OIC (officer in charge) of the arresting officer to conduct a new affidavit,” Ms Pollard said.
“I can check our physical file … Mr Guest I will chase up that officer today.”
Mr Walker said the matter needed to keep progressing, as Mr Cole had been in custody almost 10 months.
“I’d say it’s an omission, but Mr Guest needs it,” Mr Walker said.
He ordered the prosecution make a full brief of evidence by May 31, 2025, including a toxicology analysis certificate and the matter was listed for committal-mention on July 14, 2025.
Mr Cole will remain in custody.
