Sam Patrick Northen-Smyth fined in Gympie court for bail breach

A young Gympie man, found passed out next to an empty bottle of Jägermeister at a Noosa beach, didn’t take kindly to being woken up.

Just 10 days after being given a bail condition not to drink alcohol, a Widgee man was found passed out next to multiple bottles on Noosa Beach.

Sam Patrick Northen-Smyth pleaded guilty in Gympie Magistrates Court to breaching a bail condition and obstructing police.

The court heard Northen-Smyth was found unconscious at Noosa Beach on February 12 this year.

Paramedics were called to check his condition and he was taken to hospital for an emergency examination.

Due to the violent outburst and agitated state of the man, police escorted QAS as they took him to hospital.

At the hospital, an alcohol breath returned a result of 0.19.

“(His behaviour) was not appropriate for hospital staff,” Sergeant Melissa Campbell told the court

Northen-Smyth was released from the hospital and subsequently arrested to be taken to the watch house.

He was handcuffed in attempt to subdue him but he resisted police when he was asked to get into the police car.

The man refused to bend his legs, locking himself into a straight position to prevent police from placing him into the vehicle.

His property was seized and police found an empty bottle of Jägermeister, whisky, bottles and cans of beer, and cans of bourbon and cola.

He was released from the watch house 10 hours later where his alcohol level was 0.098.

Northen-Smyth was fined $500 in relation to his breach of bail and sentenced to 40 hours of community service in 12 months for obstructing police officers.

Convictions were recorded.
