A Kilkivan man has been convicted of assault for slapping a house guest after a shower was taken too soon following a bathroom renovation.

A Kilkivan man who slapped his cousin’s wife during a fracas over the use of a renovated shower was fined hundreds of dollars in Gympie Magistrates Court on Monday.

Jeffrey O’Sullivan, 49, pleaded guilty to common assault and failure to appear.

At the time of the incident, he was letting his cousin and his family live with him for an extended period of time, the court heard.

On November 1, 2023, O’Sullivan forbade the houseguests from using the shower in order to let the floor dry after renovations.

Police prosecutor Christie Mahoney told the court that upon discovering his cousin had used the shower against his wishes, O’Sullivan yelled that “the shower would be dry if we didn’t have a poofter living here”.

The court heard O’Sullivan yelled “get the fuck out of this house”, to which his cousin responded “it’s not your house”.

The property belonged to the grandmother, who had moved to an aged care facility months prior.

The cousin’s wife got involved to protect her husband from O’Sullivan’s verbal abuse, the court heard. That is when O’Sullivan slapped her.

The verbal abuse and sound of the slap were caught on video.

“You’re allowed to feel frustrated,” Magistrate Bevan Hughes said.

“The slap is where you’ve gone too far.”

O’Sullivan did not show up to an earlier court date as he had Covid, but failed to notify the court. The court heard he suffered PTSD and received a pension.

He was fined $500 and a conviction was recorded.
