Three people faced Gladstone Magistrates Court on Monday and pleaded guilty to various offences from unlicensed driving to high range drink driving.

Mandeep Singh, 25

A driver intercepted by police on Gladstone’s main street exhibited extremely drunken behaviour before returning an alarming blood-alcohol reading.

Mandeep Singh, 25, pleaded guilty in Gladstone Magistrates Court on Monday to driving under the influence of alcohol.

Police prosecutor Kelvin Boyd told the court police saw Singh driving a white Mitsubishi Lancer driving along Goondoon Street at 2.50am on December 12.

Singh swerved over the double white lines as he passed them and police heard Singh sound his horn.

Police followed Singh onto Auckland Street and saw his vehicle slow down and swerve to the left of the lane and then towards the centre of the road.

He then made a sharp turn into the driveway of a unit complex.

Police approached Singh who submitted to a roadside breath test and was subsequently transported to the Gladstone Police Station for a further test.

At 3.20am Singh’s test at the police station returned a positive reading of 0.151 per cent.

He offered no emergency or lawful excuse for driving and was subsequently issued a notice to appear in Gladstone Magistrates Court.

Singh was suspended from driving for six months and fined $1200. A conviction was recorded.

David Charles Kempston, 39

Kempston pleaded guilty before Magistrate Bevan Manthey to driving a car without a driver’s licence.

Police prosecutor Kelvin Boyd read the facts of Kempston’s offending, which occurred on November 18, around 1.56am, to the court.

A court heard police were conducting patrols when they intercepted Kempston, who was driving a white Volkswagen Golf on Auckland Street, for a roadside breath test.

Police checks conducted on Kempston’s licence revealed he had been demerit point suspended on November 10, 2021 and was not due to start driving again until 19 November, 2021.

Kempston said he was aware his licence was demerit point suspended, however, was of the belief the suspension started on November 19, 2021.

He offered no emergency reason for driving and was subsequently issued a notice to appear in Gladstone Magistrates Court.

Magistrate Manthey convicted and fined Kempston $300 and suspended him from driving for six months.

Mr Manthey told Kempston the new laws regarding demerit point suspended driving introduced by the Federal Government recently eliminated his ability to use discretion when sentencing.

No conviction was recorded.

Ryan Pearce, 50

Pearce pleaded guilty to driving of a car without a driver’s licence.

Police prosecutor Kelvin Boyd read the facts of Pearce’s offending to the court, which occurred on December 10, around 9am.

A court heard Calliope police were conducting patrols on French Street when they intercepted Pearce driving a Nissan.

Police checks on Pearce’s licence revealed it had been suspended by SPER on September 26, 2021 and he was therefore unlicensed.

Pearce stated he was not aware his licence had been suspended as he had not received any correspondence from SPER.

A phone call to SPER and further questioning identified Pearce had incurred a SPER debt due to the non-payment of a parking fine.

Pearce stated he was of the belief he was contesting the parking fine and he had not received any correspondence from the council in relation to the fine.

Pearce said he had moved home and had not updated his contact details with Queensland Transport.

He could offer no emergency reason for driving and was subsequently issued a notice to appear in the Gladstone Magistrates Court.

Magistrate Bevan Manthey convicted and fined Pearce $300 and suspended him from driving for one month. A conviction was recorded.

No conviction was recorded.
