Accused rapist granted bail in Gladstone Magistrates Court

A Central Queensland man charged with rape has made a successful bid for freedom in court after the prosecution alleged he had referred to his penis as “an entity of itself”.
The man in his 30s appeared in custody in Gladstone Magistrates Court on Tuesday, September 19, where his bail application was heard.
He is charged with two counts of rape - domestic violence offence - and was not required to enter a plea.
The court heard the alleged victim and the man had been in a “short relationship”.
Solicitor Cassandra Ditchfield said the man, a father who had sole care of his children, worked in the Gladstone region and he would be contesting the charges.
Ms Ditchfield said this matter was “realistically he said, she said”.
The court heard the man’s proposed bail address was not in Gladstone and Ms Ditchfield told Magistrate Mary Buchanan that she could put conditions on her client’s bail.
The prosecution opposed bail saying the man’s proposed residential address was “unsuitable” and that he posed an “unacceptable risk” to the alleged victim.
The police prosecutor said the alleged victim, when speaking to police, had “recounted the events in great detail” and had provided that same version to witnesses.
“Which goes to her credibility...,” the prosecutor said.
The police prosecutor also referred to text messages in which the man had allegedly referred to his penis as “an entity of itself”.
Magistrate Buchanan said she would not expect a trial to happen until next year and she granted bail with strict conditions including a curfew and reporting obligations.
Ms Buchanan also ordered the man have no contact with the complainant or witnesses and the matter was adjourned to a later date.
