A young man has been sentenced over what Hervey Bay Magistrates Court heard was a “very serious” assault on a flatmate.
Dean Anthony Fuller, 20, pleaded guilty to assault occasioning bodily harm, contravening an identifying particulars order and a DNA notice after an incident at his aunt’s house in Ipswich on April 15, 2024.
Police prosecutor Louese McConnell told the court Fuller was asked to keep his voice down after complaining two female housemates had woken him up by talking on the nearby couch.
She said one told Fuller that if he did not respect the homeowners, he needed to leave.
The argument continued, which led to the flatmate grabbing Fuller’s belongings and walking to the door, eventually throwing his bag outside the dwelling after he continued to yell.
He then approached the flatmate, grabbing and pushing her, making her fall on her back.
Fuller stood over the victim while she was on the ground and punched her with both fists closed approximately six times, the court heard.
The other flatmate yelled at him to stop, which led to her getting chased into the house by Fuller.
The women went to a bedroom where Fuller approached the door and kicked the same flatmate who had ordered him out in the left side of her face.
She later told police she was “seeing stars” after the blow to her head.
Both women screamed which led to the homeowner attending the property and promptly removing Fuller from the premises.
The incident was reported to police and the victim’s injuries were photographed.
Fuller was located at an address in Hervey Bay on August 7 and was issued with a notice to appear for this charge.
In a statement to police, the victim was reported to have received severe bruising, a contusion to her left eye socket, bruising to her right lower jaw, and grazing on her shoulder.
Fuller’s defence lawyer, Virginia Ukpabi of Geldard-Sherrington Lawyers, asked for a sentence involving a community order and said he was going through withdrawals at the time of the offending, which “explained his aggressive behaviour.”
Magistrate Trinity McGarvie described the matter as “very serious”.
A conviction for the contravention charge was recorded with no further punishment.
He was allowed bail on the AOBH charge which was adjourned to January 14, 2025.
