Gayndah man found not guilty of grievous bodily harm

A jury has found a man not guilty of grievous bodily harm after the court heard the other man was attempting to rape his girlfriend.

A Gayndah man has been found not guilty of grievous bodily harm after he faced trial in Hervey Bay this week.

The man, who cannot be named for legal reasons, faced trial before Maryborough District Court in relation to the charge, which stemmed from an incident in Gayndah on November 16, 2022.

Two very different versions of events were presented to the jury as testimony was given by the complainant and by the defendant’s girlfriend.

Crown prosecutor Nicole Hopper said in her opening statement the defendant had made the triple-0 call that night, confessing to the operator “he’s going to f**king die”.

The man then told the operator the man had been “trying to rape his girlfriend” and he “beat the s**t out of him.

Ms Hopper said the complainant suffered significant injuries including bruising to both eyes, fractures around his left eye and a skull fracture at the back of his head.

The defendant told emergency operators: “I f**king smacked him really hard, he’s bleeding out his brain.’’

“I beat the s **t out of him. He was trying to rape my girlfriend.”

The jury found the man not guilty on Wednesday of grievous bodily harm.
