The matter for a man faced with two counts of attempted murder has been mentioned in court again with the magistrate labelling the outstanding materials needed for the case to proceed as ‘perplexing’.
It was further alleged the 32-year-old man was located by police days later where he lunged at an officer with a small weapon.
Defence lawyer Brad Skuse appeared on the man’s behalf in court Tuesday morning where he declared the body worn camera footage and the digital download was still outstanding
Police prosecutor Chris Hutchins said he had received an update from the arresting officer who was not wearing a body worn camera at the time of the arrest and therefore the footage didn’t exist.
“The cellebrite records are lost. Due to the seriousness of the charges I double checked that before placing it on the record. They are lost,” Sergeant Hutchins said.
Magistrate Kyna Morice queried the missing materials.
“They’re charges of attempted murder, I find it perplexing they don’t have that material,” she said.
Mr Warwick has been charged with two counts each of attempted murder, failing to appear in accordance with undertaking, and one count each of failing to remain at an incident, possessing explosives, possessing property suspected of having been used for drugs, possessing drug utensils, serious assault of police while pretending or being armed with a weapon and wilful damage.
He has not yet been asked to enter a plea.
Ms Morice adjourned the matter to August 29 for mention, and ordered Mr Warwick to be remanded in custody.
