Man on probation for having sex with a 15 year old

A young man who met a girl on Snapchat has faced five counts of carnal knowledge of a child after having sex with her in a car, a shower, a bed and even at a grandmother’s home.

A man has faced Gympie District Court for 6 counts after an inappropriate relationship with a 15 year old.

A young man who had sex with a girl under the age of 16 after they met on Snapchat has faces six charges in the Gympie District Court, including five counts of carnal knowledge of a child and one of indecent treatment of a child under 16.

The charges stemmed from events in 2021 but the court heard the Crown wanted to pursue further charges, which prevented the defendant from pleading guilty and finalising the matter sooner.

The court agreed that the victim initiated the sexual advances, continued contact with the defendant, and there was “no absence of consent’’.

But a child under the age of 16 cannot legally consent.

Some of the indecent interactions included sex in a car, a shower, a bed, and even at a grandmother's home.

Most of the interactions occurred during Christmas and New Years celebrations.

The victim later regretted the improper interactions and filed a complaint with the police, claiming to be experiencing mental health issues and completing a victim impact statement.

Each offence has a maximum of 14 years imprisonment and being registered as sex offender.

Due to the willingness to accept the offences, co-operation throughout the investigation, and closeness in age, Judge Cash only put the defendant on a one year probation order as they were not conducting themselves in a predatory, exploitative, or coercive manner.

The man was placed on a 1 year probation order after the court found him to not be acting in a predatory or coercive manner.

The conditions of a probation order are not committing another offence, reporting to a Probation and Parole Service district office as directed, participating in programs or counselling, getting permission before leaving the state, and telling a correctional officer if you change your address or employment status.

A breach of any of these conditions will automatically send the defendant back into court will no possibility of parole, which would result in being registered as a sexual offender and the possibility of jail time.
