A Bundaberg court has heard the moment a road rage incident took a terrifying turn when an at-large criminal fired his gun at a father after he rear ended the man’s car on a stolen motorcycle.

James Kenneth Anthony Scouller, 29, pleaded guilty and was convicted of unlawful possession of a weapon used to commit an indictable offence, committing a malicious act with intent and unlawful possession of a weapon.

The court heard Scouller was riding a stolen motorbike through the streets of Bundaberg on August 23, 2022 when he rear-ended a white ute stopped at the traffic lights on Takalvan Street, outside the Sugarland Shopping centre entrance.

Crown Prosecutor Erin Hanlon presented two videos to the court, the first was filmed by a bystander and showed a passenger of the ute stepping out of the car to confront Scouller.

The court heard the passenger began filming Scouller, asking where the registration plates of the bike were as they weren’t visible on the bike.

Scouller wheeled the bike aggressively towards the man, before stopping and removing a shortened 22. rifle attached to a gel blaster frame and saying “that’s my number plate,” the court heard.

In the first video, bystanders can be heard commenting on the scene, before the camera was lowered with one witness shouting “he’s got a gun!”

Mrs Hanlong presented a second video to the court, showing CCTV footage from Sugarland Shopping Centre focused on the entryway into the centre.

The footage showed the driver of the white ute, the wife of the man who had confronted Scouller, driving the car into the parking lot while her husband followed on foot.

In the footage, Scouller can be seen slowly riding his bike the wrong way down the exit lane of the shopping centre, before getting off his bike and approaching the husband on foot, pulling his weapon as he did.

When he was only a few metres from the husband, Scouller lowered his gun, before raising it once more, this time shooting it at the husband who ducked and avoided being shot.

The court heard Scouller then fled the scene, but police were able to identify his “distinctive leg tattoos” and he was apprehended days later, still carrying the weapon.

Barrister Philip Hardcastle appeared for Scouller and told the court he had spent much of his life in and out of state care and prison, where he received regular opioid injections for his drug addiction.

The court heard at the time of the incident in August, Scouller was considered at-large by police after he failed to comply with parole expectations set on his release from prison in June 2022.

Judge William Everson commented on Scouller’s “sinister” and “heinous” offending which left a young family in fear of their lives.

“It would have been truly terrifying for both him and his family, and also other passers-by,” he said.

“I am therefore quite certain that members of the public felt most concerned by this gangster like activity occurring on a busy street in Bundaberg.”

Scouller was sentenced to five years jail for the malicious act charge, three years for possessing a weapon used to commit an indictable offence, and 18 months for possessing a weapon, to be served cumulatively.

Eighty-two days of 466 days spent in presentence custody was declared time served. Scouller will be eligible for parole on May 14, 2025. Convictions were recorded.
