A man swore at the magistrate after his bail application was refused for a string of charges including assault occasioning bodily harm, fraud and evading police.

Jamie John Blake applied for bail in Bundaberg Magistrates Court on Monday, August 14, while facing a range of charges incurred between 2019 and 2021.

The charges include assault occasioning bodily harm whilst in company, obstructing a police officer, fraud, stealing, driving without a license disqualified by a court order, evasion and three charges of failure to appear.

The court heard Mr Blake, 36, has charges pending before an ACT court, where he has a hearing on August 20.

Representing himself and appearing from custody via videolink, Mr Blake told magistrate John McInnes he would like to be released on bail to attend court in the ACT, after which he would return to Bundaberg to face the current charges.

Mr Blake said he would like to return to Bundaberg “where it’s nice and warm” because the cold weather in the ACT exacerbated his arthritis.

Magistrate John McInnes refused bail, citing Jamie Blake's (pictured) multiple failures to appear and matters pending in an ACT court.

Mr McInnes observed to Mr Blake that “the arthritis didn’t seem to bring you back to answer these charges”, and given his multiple failures to appear and matters pending in the ACT courts, he would be refusing bail.

Mr Blake then said he would be referring his matters to the Supreme Court, in response to which Mr McInnes said the Supreme Court did not have jurisdiction over the charges Mr Blake was facing.

Incensed, Mr Blake said the judgement handed down by Mr McInnes was “absolutely f-----g disgusting”, and claimed federal legislation gave all defendants the right to bail without the need to show cause.

Mr McInnes said “we go by the Bail Act of Queensland up here”, and that Mr Blake “fail(s) to recognise what the law actually is”.

Mr Blake was refused bail and his matter adjourned to August 28 in Bundaberg Magistrates Court.
