A Darwin delivery driver who fatally killed one person and injured two others before fleeing the scene was sentenced at Darwin Local Court on Thursday.

Aryan Aryan 22, was sentenced for hit and run driving causing death and two counts of hit and run causing serious harm for an incident that occurred on a Brinkin cul-de-sac in the early hours of April 19, 2024.

Judge Giles O’Brien-Hartcher sentenced Aryan to four months home detention starting immediately for the death of one of the victims.

For the other two counts of causing serious harm he was sentenced a further seven months suspended immediately.

In May last year the court had heard details of the offending which occurred during Aryan’s delivery route with the victims asleep on the road.

“They all suffer(ed) serious, life-threatening injuries, multiple fractures and head injuries,” judge Therese Austin told the court.

“As [Aryan] reverses, it’s alleged he illuminates the victims in his headlights so he becomes aware, potentially, that he has driven over people.

“He panics, potentially, but he realises what’s occurred, he drives way from the scene, he fails to stop and render assistance.”

Judge Austin said Aryan then allegedly “continues his delivery route” before returning to the depot in Berrimah where he told someone else what had happened.

“They tell him they need to return to the scene, that’s exactly what happens, he goes back with another person, they find the injured parties,” she said.

“They then ring triple 0 but he doesn’t identify himself, that’s his second mistake, allegedly, but he remains there until the police and the ambulance arrive.

“The victims are taken away, he’s spoken to by police but he doesn’t identify himself again as the driver, third mistake, potentially.”

Judge Austin said it was not until later that morning that Aryan’s employer contacted police and the two men went into the station where he “admits his involvement”.

Days after the incident, detective senior sergeant Brendan Linder had confirmed the two men and woman were “sleeping on the roadway” at the time of the strike.

Aryan was driving for Top End Distribution at the time, a delivery company subcontracted to deliver newspapers for NT News.
