A young mum who was caught drink driving while her five-month-old was in the vehicle has been banned from driving for three months.
The court heard in April, 24-year-old Montana Givney visited her sister-in-law in Brisbane, where she spent the evening drinking.
Police prosecutor Anita Page told the court Boondall Police attended the Chermside address just after midnight on April 21, after receiving a report that an intoxicated Givney was attempting to leave the property with her baby in a vehicle.
The court was told police located Givney driving in her vehicle a short time later, and returned a blood alcohol reading of 0.140.
Ms Page told the court Givney was unable to provide police with a reason for getting behind the wheel.
Defence lawyer Claire Graham of Skuse Graham Criminal Lawyers told the court her client had intended to stay overnight at her sister-in-law’s house, and had been drinking at the address from around 4.30pm.
Ms Graham told the court Givney’s partner made unsuccessful attempts to stop her from leaving, before she drove a short distance away with their five-month-old in the vehicle.
The court was told Givney’s behaviour was extremely out of character.
Magistrate Clare Kelly told Givney she was lucky the police stopped her when they did.
“You are very fortunate that you were stopped at that point and I hope you appreciate what a very bad decision that was of yours to get in the car, particularly with a very small baby,” she said.
Givney pleaded guilty to one count of drink driving.
She received a fine of $650 and a three month licence suspension.
No conviction was recorded.
