A business that appealed an $82,000 stormwater infrastructure charge from Toowoomba Regional Council has had a win in the Planning and Environment Court.

Green Distillation Technologies secured an approval from TRC for its proposed tyre recycling plant at Wellcamp Business Park in May 2019.

But it was slugged with an $82,222.20 infrastructure charge notice for stormwater – prompting the company to argue in court that “there is no stormwater trunk infrastructure servicing the land the subject of the development permit”, nor was it planned to be provided.

“The amount of the charge is so unreasonable that no relevant local government could have imposed the amount,” the appeal said.

The Planning and Environment Court in late September agreed, setting aside the original infrastructure charges notice and substituting it with an amended infrastructure charges notice of $3366.90.
