The singer spent the night in jail after police said they found him “glassy eyed” in his BMW and swerving to the wrong side of the road.

Justin Timberlake allegedly swerved to the wrong side of the road twice, refused to take a breathalyser test three times and was “glassy eyed,” according to a police report which has emerged following his shock arrest for drunk driving.

And a witness at the bar Timberlake had been drinking at that night claims that he was “wasted” and was even seen helping himself to someone else’s drink.

“At one point, just before closing, somebody got up to go to the bathroom and left his drink on the table,” the source told Page Six.

When the man came back, he found Timberlake “drinking his drink.”

“The guy goes, ‘Justin, that’s my drink!’” the source claimed.

Timberlake, 43, was taken into custody after an incident in the ritzy Hamptons area of Long Island, in New York State, early on Tuesday morning, local time.

He was held overnight in a cell at East Hampton police station, 160km east of New York City, and then released late on Tuesday morning without bail following a court appearance in nearby Sag Harbor where he was charged with one count of driving while intoxicated.

Timberlake was reportedly handcuffed on his journey from the police station to the courthouse.

US network NBC has cited a criminal complaint written by a police officer that said Timberlake was pulled over at 12.17am on Tuesday (2.17pm AEST) after his BMW rolled through a stop sign and twice went onto the wrong side of the road.

The officer was so young he didn’t recognise Timberlake even when the star told him his name, reported the New York Post.

“He didn’t recognise him or his name,” an insider claimed.

A second source added, “Justin said under his breath, ‘This is going to ruin the tour.’ The policeman replied, ‘What tour?’ Justin said, ‘The world tour.’”

Timberlake was ‘glassy eyed’

Once pulled over, according to NBC, the officer observed that Timberlake “was operating said vehicle in an intoxicated condition in that his eyes were bloodshot and glassy, a strong odour of an alcoholic beverage was emanating from his breath, he was unable to divide attention, he had slowed speech, he was unsteady afoot, and he performed poorly on all standardised field sobriety tests”.

‘Let him go’

“I had one martini and I followed my friends home,” Timberlake allegedly told police.

But the complaint said he refused a blood-alcohol content test three times over the course of 40 minutes. The encounter with Timberlake was filmed on police body cams.

It was reported by People magazine that Timberlake had been having dinner at the American Hotel in the up market town of Sag Harbor in the Hamptons.

The restaurant serves dishes such as roasted bone marrow and veal sweetbreads (offal) as well as three types of caviars.

The publication quoted a source as saying the star was driving to a friend’s house after leaving the restaurant and was pulled over. “Nobody was hurt,” the person said.

Entertainment website TMZ added that “Justin’s friends came on scene and tried to convince cops to cut him a break, but they refused”.

The New York Post added that when he was approached by police, Timberlake’s friends pleaded “Let him go, let him go“. But to no avail.

The singer was accompanied by his lawyer to court and was handcuffed and wearing a black shirt, jeans and Nike Air Force 1 basketball shoes. His wife Jessica Biel was not with him.

Timberlake’s next court date has been set for July 26.

The Grammy winner is currently touring with his Forget Tomorrow world tour.

He last performed on Saturday in Miami and has two concerts planned for Friday and Saturday in Chicago and then next week at Madison Square Garden in New York City.

The SexyBack singer has not spoken out about the incident on social media. His last post was on Sunday for Father’s Day, reported the New York Post.

“My 2 greatest gifts. I learn more about myself everyday just because you both chose me to be your Daddy,” he captioned a pair of photos with his two sons, Silas, 9, and Phineas, 3.

“I will always be there for you through your peaks and valleys … to lift you up and show you how high you can take this life and to pick you up when you fall. And, of course, to flood you with insufferable Dad-jokes all along the way. I love you both so much. Thank you for giving me my biggest purpose.”
