Exclusive: Allan Endresz allowed to race horses in Victoria again as Alligator Blood owners seek court injunction

Victorian stewards have allowed colourful owner Allan Endresz to race horses again, as a separate court injunction bid kicked off in Queensland over star racehorse Alligator Blood.

More than two years since being banned from racing horses, Victorian stewards have given colourful owner Allan Endresz the green light to race horses in Victoria again.

News Corp can reveal the news on the same day Endresz and the other original owners of Alligator Blood sought a Queensland Supreme Court injunction to stop a third stewards’ inquiry into the 2020 Gold Coast Magic Millions 3YO Guineas controversy.

Unrelated to the court action, Victorian chief steward Rob Montgomery has written to Endresz to advise he is allowed to race horses in Victoria again.

In August 2022, Endresz was barred from owning horses in Victoria due to his status as an undischarged bankrupt.

Alligator Blood was later allowed to race after Endresz relinquished his ownership share and billionaire businessman and Magic Millions supremo Gerry Harvey purchased the majority share of the headline horse.

But now Endresz is back in business and can own horses which race in Victoria.

“The stewards are satisfied that the bankrupt ownership issue has now been resolved,” Montgomery wrote to Endresz this month.

“In relation to the ownership ascertainment issue, whilst maintaining some concerns regarding transparency, the stewards have determined to allow horses for which you are a registered owner to again race in Victoria.”

The development comes as Endresz and Alligator Blood’s other original owners Jeff and Robyn Simpson on Friday sought a Queensland Supreme Court injunction to restrain stewards from conducting current and future inquiries into the 2020 Gold Coast Magic Millions 3YO Guineas controversy.

It is more than five years into the long-running drama since Alligator Blood was originally stripped of the 2020 $2m Magic Millions Guineas win and the prizemoney cheque, following a positive swab to the banned substance, altrenogest.

But Endresz and co were handed a thumping win in court when Justice Morrison, of the Court of Appeal, ruled in favour of a court’s original decision to sensationally void Alligator Blood’s disqualification as it ruled owners were never an opportunity to be heard by stewards before the disqualification.

Queensland stewards later announced they would attempt to re-hear the matter in a third inquiry.

On Friday in the Supreme Court, Endresz and the others owners sought to shut down a third stewards' inquiry into the matter, stop any future investigations and seek prizemoney payment of $978,945.

The Queensland Racing Integrity Commission and Racing Queensland are the respondents in the civil action.

Barrister Katherine McGree, acting for Endresz and the Simpsons, submitted to Justice Martin that “the lawful power of the stewards had been exceeded” and the second stewards’ inquiry into the matter had been “discontinued without any reasonable diligence.”

McGree said Alligator Blood’s “A” swab sample from 2020 is now unreliable because of laboratory flooding and “even QRIC’s own experts say it is unlikely it could be reliably analysed now.”

She also said, more than five years on since the saga, an unreasonable amount of time had elapsed and Endresz and the other owners already had a court ruling in their favour.

Justice Martin said he would take time to consider his decision which would be handed down at a future date.

Saturday marks five years since Alligator Blood won the first of his Group 1s, the Australian Guineas at Flemington.

After a long injury lay-off and a change of trainer from Gai Waterhouse and Adrian Bott to Chris Waller, seven-time Group 1 winner Alligator Blood could make a fairytale comeback in the Group 1 All Aged Stakes on the final day of the Sydney autumn carnival on April 19.
