NIGHTCLIFF Tigers division two leading goal kicker Kian Wise has been granted bail on a $5000 surety following an alleged “cowardly” late night attack on Mitchell St on Christmas Eve.
Wise, 20, applied for a bail review in the Supreme Court after being charged with intentionally causing serious harm, for which bail was denied by the Local Court last year.
In releasing Wise on Tuesday, Chief Justice Michael Grant said the brawl began as a “large disturbance” involving “many of the patrons” at Monsoons nightclub shortly after 3am which spilled out onto the street.

“This included (Wise), in what can only be described as a grossly cowardly fashion, punching the victim in the head from behind while the victim was being assaulted by (his) associate — he shouldn’t be very proud of that,” he said.
“The victim was then assaulted repeatedly and savagely by (Wise’s) associates, including by kicking and stomping on his head while he lay defenceless on the ground.”
A statement of facts tendered to the court alleges co-accused Ashleigh Epiha, 18, then removed the victim’s shorts and threw them at him before pulling down his underwear and taking a photo of him with her phone.
Chief Justice Grant said Wise and the other co-accused then continued to attack the man.
“While the victim was lying unconscious and naked on the ground, (Wise) ran over and attempted to kick him in the head — again not something to be particularly proud of,” he said.
“There is a dispute as to whether that kick made contact with the victim’s head but there’s no doubt the intention was there.”
The alleged facts describe the overall attack as “ferocious and would be described as a frenzy with total disregard to the victim’s life”.
But in granting bail, Chief Justice Grant while the evidence against Wise was “substantial” he wasn’t the “main protagonist” in the assault and had no history of violence.
Wise will be banned from drinking or visiting licenced premises and will be subject to electronic monitoring while on bail.

Prosecutor Damien Jones told the court he had been in discussions with the defence and there was “potential room for resolution” of the case without the need for a trial.
He returns to court for a further mention tomorrow.
