THE owners of popular Cullen Bay night spot Lola’s Pergola have agreed to pay a fine for allegedly breaching coronavirus restrictions in May after a five month court battle.

Matt and Kitty Mulga initially contested the on-the-spot fine after allegedly failing to adhere to social distancing guidelines at the venue as per the Chief Health Officer’s directions at the height of the coronavirus pandemic.

But in seeking an adjournment for another week in the Darwin Local Court on Monday, their lawyer, Jon Tippett QC, said after discussions with the prosecution, the parties had “arrived at a very sensible position”.

“A new ticket will be issued and three days within the period of that being issued and served upon us, we will be paying the fine,” he said.
