Ms Gwynne is facing an abuse of office charge in the Darwin Local Court which she has indicated she will defend if the case is committed for trial.
On Wednesday her barrister, Giles O’Brien-Hartcher, told judge Therese Austin Mr Allen would be among the witnesses the defence team would seek to cross examine during the committal process.

Prosecutors oppose the cross examination and in a heated exchange with Mr O’Brien-Hartcher, Ms Austin declined to set a date to hear arguments on the question, instead adjourning proceedings until February 17 “for an allocation of dates”.
