A POPULAR tavern will be barred from selling takeaway grog for 24 hours in November after staff failed to use their banned drinker scanner more than 50 times

THE Humpty Doo Tavern will be barred from selling takeaway grog for 24 hours on November 10 after staff failed to use their banned drinker scanner more than 50 times.

The pub’s licensee, Epsomm Pty Ltd, will also have to install point of sale CCTV cameras after admitting breaching the BDR requirements 54 times over three days in January.

Company directors Guy Dunne and Andrew Case wrote to the Liquor Commission in April outlining improvements made to their staff training practices following the breaches.

“We recognise the importance of further, ongoing and more detailed training and accept that more can be done in this space,” they said.

“Staff will receive refresher BDR training every six months of their employment, as part of our commitment to correct use of the BDR.”

In suspending the Tavern’s licence, the commission accepted the business owners had a good compliance record, were genuinely remorseful and were committed to ensuring staff received necessary further training.

But chairman Richard Coates ruled the 54 breaches represented a 16 per cent failure rate, which was “way in excess of what might be regarded as an unavoidable level of error”.

“We have little doubt that the licensee would not tolerate its employees undercharging customers in 16 per cent of transactions,” he said.

“So it is unrealistic to expect the commission to accept that although proven, the level of noncompliance with this beneficial legislation is not deserving of penalty.”

Mr Coates said while he accepted the business had policies in place to remind staff of their responsibilities “the message needs to be brought home to them that there will be consequences for their sloppy work practices”.
