Man penetrated by cucumber should get long sentence for ‘sick’ rapes, court

A man who subjected a sex worker to ‘sick’ sexual acts against her will before claiming she anally penetrated him with a large cucumber ‘should get a long jail sentence’, a court has heard

A MAN who subjected a sex worker to “sick” sexual acts against her will before claiming she anally penetrated him with a large cucumber “should get a long jail sentence”, a court has heard.

Jeffrey Smith, 60, was found guilty at trial of two counts of rape and two counts of gross indecency after prosecutors said he dragged the woman into his unit where she “tried to fight him off” in August last year.

He was acquitted on two other counts of rape and one each of deprivation of liberty and aggravated assault.

In submissions on sentencing on Wednesday, Crown prosecutor Stephen Geary read from a victim impact statement in the woman described her shame at the “horrible assault”.

“It made me feel sick what happened to me and what this person wanted me to do was sick — it made me feel ashamed,” she said.

“I really don’t know how to put into words what happened to me, I’d hate for this to happen to another person.

“I think Jeffery Smith should get a long jail sentence.”

In urging Justice Jenny Blokland to order an institutional report prior to sentencing, Smith’s lawyer, Giles O’Brien Hartcher, said his client had been in protective custody while on remand but had been moved into solitary confinement since the guilty verdict.

“He has been in solitary confinement in the maximum security wing and he’s tried to find out why that is but hasn’t been given an answer, he says he’s been in a hot cell by himself,” he said.

“We don’t know how long that’s going to go on for but that’s obviously quite an onerous and difficult way to spend time in prison.”

When initially questioned by police, Smith to explain away a window the woman said she broke while he assaulted her by saying it happened while she anally penetrated him with a cucumber, a story Mr O’Brien Hartcher said was “too embarrassing” to make up.

Smith will return to court for sentencing next month.
