Dad granted bail after facing court on drink/drug-driving, unrestrained child charges after fatal crash

A FATHER who was allegedly behind the wheel of a four-wheel-drive that crashed outside Adelaide River last August killing his young son has faced court charged with drink and drug-driving

UPDATE: A MAN who police allege caused the death of his five-year-old son in a crash outside Adelaide River last year has been bailed to live with his sister in law.

Jye Mulhall, 27, faced the Darwin Local Court on Thursday charged with drink and drug-driving, driving with an unrestrained child in the car and driving causing the death of Dmitri Charles Mulhall on August 13.

In granting Mulhall bail, judge Greg Macdonald ordered him to live with his sister in law in Moil, not drink or drive a car and keep to a curfew between 9pm and 7am.

His lawyer, Thelma Gray, said her client had made appointments with a psychologist and a neurologist and would also undergo grief and trauma counselling.

Mulhall will return to court on April 29.

EARLIER: A FATHER who was allegedly behind the wheel of a four-wheel-drive that crashed outside Adelaide River last August killing his young son has faced court charged with drink and drug-driving.

Jye Mulhall, 27, appeared in the Darwin Local Court on Thursday where he also faced allegations of driving with an unrestrained child in the car and driving causing the death of five-year-old Dmitri Charles Mulhall.

The court heard Mulhall also faces a separate allegation of high-range drink-driving from July last year.

His lawyer, Thelma Gray, told the court he missed his January 29 court appearance for that charge after being taken to hospital suffering seizures two days earlier.

Ms Gray said Mulhall was again taken to Royal Darwin Hospital on January 30 suffering “confusion” and it was unclear whether his medical condition was related to an “accident” that happened after he was charged with drink-driving.

Ms Gray requested her client be excused from his next appearance as he may not be able to get to Darwin from his home in Adelaide River due to flooding and was also due to have shoulder surgery in Brisbane.

Mulhall appeared in court on a summons after being charged over the August crash but prosecutor Laura Payne said she opposed bail being granted on Thursday.

Ms Payne said if he was bailed it would have to be on strict conditions and he shouldn’t be allowed to leave Darwin.

Judge Greg Macdonald stood the hearing down until 2pm so Mulhall could be assessed for bail supervision.

“His whole situation is chaotic and quite concerning,” he said.
