Compensation claim brought by wife of Inpex worker Carl Delaney, who died in workplace incident, returns to court

A civil action, that could see the family of a Darwin carpenter killed when he fell from scaffolding at an Inpex construction site, receive up to millions in compensation returned to court.

THE parties to a civil action that could see the family of a Darwin carpenter killed when he fell from scaffolding at an Inpex construction site receive millions of dollars in compensation, are continuing to chase up critical documents key to proceeding with the case.

Carl Delaney suffocated after he fell into insulation while undertaking repairs on a cryogenic tank in November 2017.

Early this year his wife Terry launched civil action in the Supreme Court on behalf of herself and Mr Delaney’s three sons, as well as his mother and brother.

She is seeking compensation for the loss of her husband’s income as well as for the grief suffered by each of his family members and her own personal suffering at the loss of her husband.

As well as Inpex, the action also includes JKC Australia LNG, Ichthys LNG and subcontractor Kawasaki Heavy industries (KHI), a company against which criminal charges relating to Mr Delaney’s death were dropped in the Darwin Local Court last year.

At a directions hearing in the Supreme Court on Tuesday, the court heard the parties were still collecting all necessary documents and the plaintiff was particularly seeking the “critical” records of the unredacted version of the WorkSafe investigation report into Mr Delaney’s death and his coronial file.

It also heard a separate, ongoing criminal action against subcontractor Whittens Group, Mr Delaney’s employer, could be holding up access to certain documents.

The case is due to return to court on September 10.
