A man who allegedly killed an 11-year-old boy by pinning him to a wall with his ute in a Moulden car park will face trial in the Supreme Court.
Wayne Peter Hunt, 54, was not required to enter a plea when his charge of dangerous driving causing death was read at the Darwin Local Court on Wednesday.
Hunt’s lawyer Matt Hubber told the court the defence accepted there was a prima facie case.
“The two pieces of evidence that he was driving and the toxicology report constitute the dangerous nature of the charge,” he said.
The court heard there was CCTV footage of the incident which was not tendered.
Judge Thomasin Opie found there was enough evidence to commit Hunt to trial.
Hunt was allegedly under the influence of cannabis while driving a Dodge Ram ute in the Moulden Supermarket car park on December 20 last year.
Police alleged Hunt was trying to reverse out of a park when his car lurched forward rather than reversing, jumping the kerb and hitting Daemarius Purcell-Appo who was walking in front of the car.
The boy was pinned between the car and the wall of the bottle shop and tragically could not be revived despite desperate attempts from witnesses and paramedics.
Hunt has been charged with driving causing death, driving unlicensed and driving with a prohibited drug in his body.
He will next face court on October 19 for a criminal call-over.
