Port Augusta netballer Kayla Jade Parry sentenced for gross indecency over Adelaide Hungry Jack’s sex act

A mum and “highly-ranked” netballer performed a sex act on a man at an Adelaide Hungry Jack’s beside the playground, a court heard – now she’s been punished.

A Port Augusta netballer and mum-of-three has avoided a conviction after she was caught on CCTV performing oral sex on her then-partner inside an Adelaide Hungry Jack’s near the playground.

Prosecution told Christies Beach Magistrates Court on Thursday a manager at a Hungry Jack’s restaurant in Seaford saw Kayla Jade Parry, 30, and her co-accused on CCTV engaging in the act while seated at a booth near the playground exit in January 2024.

The court heard the man was “exposed” and Parry’s head was “moving up and down”.

Police were called to the restaurant and viewed the CCTV footage.

Ms Parry earlier pleaded guilty to the charge of a grossly indecent act.

The court heard the co-accused is currently in jail “in relation to various matters” and had introduced Ms Parry to meth while they were together.

Ms Parry’s lawyer described the incident as “a brief lifestyle aberration” and asked she not be convicted of the offence.

“It was very much out of character and fuelled by the circumstances at the time,” he said.

The defendant has three children from previous relationships, aged 12, 8 and 5, with the youngest child residing in Queensland, and her lawyer said a conviction would have significant consequences.

He said Ms Parry has been drug free since February this year and has established a new life in Port Augusta, where she has been able to get a house and has been successful in sport, playing for a netball club there.

“She has been a premier league netballer, a very highly ranked netballer,” he said.

He added that she was now looking for employment and about to start a certificate four in mental health counselling.

In sentencing Ms Parry, Magistrate Kylie Schulz said it was a serious example of the offence of grossly indecent act, which has a maximum penalty of a term of imprisonment of up to six months or a fine of up to $2500.

“There were people present at the Hungry Jack’s. If there were not children, there was clearly the potential for there to be children. It’s sometimes referred to as a family restaurant,” she said.

However, Ms Schulz said she would not be recording a conviction if Ms Parry agreed to enter a good behaviour bond for two years.

“On balance, I consider it would be disproportionate to record a conviction for this offence given you have no prior offending and in the circumstances of an anti-social relationship,” she said.

Ms Schulz said her plans to obtain further qualification certificates and engaging in a healthcare plan were good prospects of rehabilitation.
