He’s pleaded guilty to serious gun and drugs charges but this alleged Comanchero bikie has asked to be freed from jail for a few weeks after a family tragedy.

An alleged Comanchero bikie who threw a loaded gun onto the roof of a neighbouring house has asked to be freed for a few weeks to attend his brother’s funeral.

Daniel John Bennett applied for home detention bail in the District Court on Wednesday to be able to grieve with his family following the tragedy.

Indianna Davis, for Bennett, told the court they were requesting bail on compassionate grounds, as his younger brother had died earlier this month.

The court heard the brother had died while on home detention bail and his body was currently with the coroner, but it was expected a funeral could be held early July.

Ms Davis said they were only asking for Bennett to be released on bail for a few weeks so he could attend his brother’s funeral before he would be returned to custody ahead of sentencing submissions next month.

“It is sought so he can be with his family and provide comfort to them in this very difficult time,” Ms Davis said.

Bennett pleaded guilty in March last year to aggravated possessing a firearm, trafficking a controlled drug and money laundering.

He was arrested on February 15 last year at a Plympton Park home after police observed him throwing a bag, containing a loaded gun, on to a roof.

A further search of the home uncovered 28g of methamphetamine, $20,900 in cash, several fake IDs and passports, Comanchero clothing and a notebook listing drug debts.

Bennett has been denied bail twice after he called on the Supreme Court to review the decision.

The application was then dismissed by Justice Sandi McDonald over his alleged links to the Comanchero Outlaw Motorcycle Gang, evidence that he might flee the state given his access to “large amounts of cash” and an iPad app to make false IDs.

Justice McDonald also said Mr Bennett’s alleged connection to the Comanchero means he was likely to leave the state if released on any form of bail.

“It is submitted that this association with the Comanchero, suggests that through his gang membership, Mr Bennett has affiliations with other gang members around Australia,” she said.

“It would also seem Mr Bennett has access to large amounts of cash given what was located at the house at the time of his arrest.”

On Wednesday, Judge Nick Alexandrides adjourned the application until next week, so he could review the Supreme Court reasons for denying Bennett bail.
