ATO asks federal court to wind up Hampton Home Builders

A building company that has done $19 million of work since launching six years ago is at the centre of a federal court fight with the Australian Taxation Office, which wants the company wound up.

A Gympie home building company is at the centre of a Federal Court fight with the Australian Taxation Office amid efforts by the ATO to wind the business up and place it in the hands of liquidators.

Lawyers for the office will return to the federal court on Wednesday, July 17, for a second hearing on the ATO application.

The Deputy Commissioner of Taxation made the application to wind Gympie Hampton Home Builders up on May 28.
Documents lodged alongside the application included consent of a proposed or provisional liquidator for the business, and affidavits in support of the ATO application.

Federal court records do not show any documents as yet lodged by Hampton Home Builders.

Details of the claim, including the ATO’s grounds for seeking the company’s closure, are unavailable to third parties as yet.

An initial hearing on the matter was held online with registrar Susie Stone on Wednesday morning, July 3.

Ms Stone ultimately adjourned the hearing for two weeks, and ordered Hampton Home Builders to file or serve any material opposing the winding up application, or in support of further adjournment, by Monday, July 15.

Hampton Home Builders was opened in 2018 by Karen Robinson.

Ms Robinson and Hampton Home Builders have been approached for comment.

Ms Robinson is one of two directors listed for the company along with John David, who is also listed as secretary.

The company’s licence was cancelled by the Queensland Building and Construction Commission in September 2023 after the business was unable to meet its financial requirements.

CoreLogic property records show the Property Shop building, which contained the Hampton Home Builders’ offices, was sold in December 2023 for $935,000,

QBCC online licence records show Hampton Home Builders worked on 84 jobs between 2018 and 2023, worth a combined total of more than $19.4 million.

In the 2023-2024 financial year, the QBCC approved six claims worth a total of $777,129.56 under the statutory insurance scheme, the licence records show.

The QBCC has issued five directions to rectify work in 2024.
