A Labrador woman has narrowly escaped spending time in prison after being caught for the fourth time selling cars without a motor dealers licence.

Emilia Lloyd pleaded guilty in the Southport Magistrates Court on Thursday to acting as a motor dealer.

It was the fourth time since 2019 that the 65-year-old has been convicted of unlicensed motor dealing.

The court was told on this occasion Lloyd had posted 27 online ads on Facebook Marketplace and Gumtree advertising 22 different vehicles for sale between July 15, 2021 and April 3, 2022.

At that time Lloyd was on a suspended prison sentence after pleading guilty to unlicensed motor dealing in March 2021 – for which she was sentenced to three months’ prison to be wholly suspended for 18 months.

Defence barrister David Funch, instructed by Howden Saggers Lawyers, told the court on Thursday Lloyd had moved to Australia from Slovakia in 1993 and since then had worked in a number of professions including as a motor dealer.

He said after her motor dealing licence lapsed she continued to sell cars.

“She never held herself out as a motor dealer or being ready to carry on that business but it’s rather based on volume and frequency and transactions which she assumes legal liability,” he said.

Mr Funch said Lloyd was currently on a disability pension and suffered from post-traumatic stress disorder.

He said her brother was currently terminally ill in Slovakia and she wanted to travel to Europe to see him.

Magistrate Michelle Dooley sentenced Lloyd to six months’ prison to be wholly suspended for two years.

She also extended the operational period of the first suspended sentence another six months.

“I don’t want to see you back here again,” Magistrate Dooly said.

“If you do, the penalty is very likely, irrespective of your age, is likely to be a period of time in custody.

“Personal responsibility does kick in at a certain point.”
