A TEENAGER who sexually assaulted his nephew has been found guilty of rape in the Supreme Court

A TEENAGER who sexually assaulted his seven-year-old nephew while he played video games has been found guilty of rape in the Supreme Court.
A jury unanimously found the man, 19, guilty of one count of sexual intercourse without consent and one count of indecent dealing with a child under 16 years.
The court heard the man was alone in a bedroom with his nephew earlier this year when the incident occurred.

During the trial, Crown prosecutor Carly Ingles said the victim was a “vibrant and bubbly boy” who loved games he could play on screens.
Ms Ingles said the boy’s uncle had a TV with a PlayStation, which he was playing with another man while his nephew was “hanging around to get a shot”.
Later, he and his nephew were playing Grand Theft Auto alone in the bedroom when he put his hands down his pants and sexually assaulted him. Shortly afterwards, the boy vomited and went outside to his mother, who was also at the residence.
The boy’s mother noticed her son was not himself.
Ms Ingles told the jury that after leaving the residence, she asked her son what was wrong, and he told her “the accused had been rude to him and had hurt him”.
The boy’s mother called police, who conducted interviews with the boy and several family members who were at the residence at the time.
The court heard the boy did not undergo a formal sexual assault examination as he became scared when he arrived at the clinic, but testing on the inside of his shorts returned positive DNA from the man in three separate areas.
Ms Ingles said there were “feelings of betrayal, distrust and shock” for the family, who were “in the middle of a family’s worst nightmare”.
The man will appear in court on February 9 2021 for sentencing submissions.
