‘Cash me outside’ girl is pissed people are using her catch phrase

THE Florida teen who made a name for herself as the “Cash Me Outside” girl is taking three gaming companies to court for using her signature phrase and voice in their new mobile apps, according to reports.

Danielle Bregoli, 14, her mother, Barbara Ann, and their company, Dani B Holdings LLC, filed a trademark lawsuit Thursday against the companies and people who developed and published the apps — named Cash Me Outside and How Bout Dat — under Anonymous Games Inc., according to the suit obtained by the Palm Beach Post.

The Bregolis seek at least $US1 million ($1.3 million) in damages in the suit, filed in South Florida federal court, the paper reported. The mother and daughter argue that they are entitled to all of the gross revenue received directly or indirectly from the game.

The complaint accuses Anonymous Games Inc., its former and current owners Josiah Jenkins and Matthew Gruettner, respectively — as well as two other companies, Appnoxious LLC and Squad Social LLC.

It calls the Cash Me Outside app an “exceedingly simple and completely unoriginal game” that is free but draws its revenue from ads and “in-app purchases,” according to the paper. The app also uses Bregoli’s voice uttering her signature phrase and uses an avatar resembling her, the complaint says.

A search of the iTunes app store reveals that Anonymous Inc. changed the app’s name to Get Cash Outside. The app also removed Bregoli’s catchphrase and replaced it with the words, “That’s Lit,” the Palm Beach Post reported.

“The reason why we had to change the beat is because the Cash Me Outside girl threatened to sue,” a woman who identified herself as Mrs Snyder from Anonymous Inc. wrote on the app store page. “We’re trying to get her to let us change it back but it may not work but we will work hard and thank you for all the comments that are helping us fix it.”

The game involves making the character jump over obstacles to collect bands of cash, according to its description on the page.

The How Bout Dat app has been removed.

The complaint says Bregoli’s reps came to an oral agreement with Jenkins back in February that Anonymous Inc. would pay them $US75,000 ($100,000) — as well as a 50 per cent revenue split on the first game.

Following that conversation, Jenkins “repeatedly made excuses for his delay” and stopped responding to phone calls, according to the complaint.

A little over a week later, the second app was published.

Once Bregoli’s reps threatened to pursue legal action against the company, Gruettner emailed them, saying he was the actual developer of the Cash Me Outside app and Jenkins was his former business partner, the complaint says.

Gruettner claimed he owned the “code and assets” for the game and wanted to come to an agreement with Bregoli and her company — but then he too broke off communications, the complaint alleges.

Gruettner told the Palm Beach Post he is the sole owner of Anonymous Games and that all other companies named in the complaint — as well as Jenkins — were never involved.

He said he expects the case will be dismissed because the app was approved on January 27, well before Bregoli’s company filed a trademark for “Cash me ousside how bow dat” on May 3.

He claimed he never filed for a trademark for the game because he usually makes games based on trending topics — and that he changed the name of the game once he learned the family had trademarked Bregoli’s catchphrase.

“The truth will come out in court as we intend to fight any accusations to the fullest extent,” he told the paper.

The sassy teen gained internet fame after she and her mum appeared last year on a Dr. Phil episode titled “I want to give up my car-stealing twerking 13-year-old daughter who tried to frame me for a crime.” She uttered her infamous line — “Cash me outside, how bow dah” — as audience members jeered at her.

Since the episode went viral, Bregoli made headlines for other instances of wild behaviour, which included punching a passenger aboard a Spirit Airlines plane. Cops also investigated a February brawl involving Bregoli and three others outside a bar in Lake Worth, Florida.
