Richard Pusey’s lawyers get access to medical records ahead of October court appearance

Lawyers for Richard Pusey, who is accused of filming a dying policewoman in the Eastern Freeway crash, have been granted access to a dossier of records ahead of next month’s court appearance.

Medical records for a Porsche driver who filmed a dying policewoman in the Eastern Freeway crash have been released to his lawyers as they continue to prepare for the case against him.

Richard Pusey, 42, remains in custody after he was charged in the days after the April 22 tragedy that left four Victoria Police officers dead.

Chris McLennan, representing Mr Pusey, fronted Melbourne Magistrates Court on Thursday where he was granted access to the 177-page medical records provided under subpoena by the Department of Justice and Community Safety.

No details emerged as to what information the records may hold or any progress on the case.

An earlier hearing heard how the mortgage broker hoped to resolve the matter as soon as possible.

But negotiations with the prosecution had hit a stalemate with neither parties willing to back down from a charge of outraging public decency.

Mr Pusey’s legal team have since applied to the court to have the charge dropped, arguing it does not exist in Australia.

They will return to court next month to make further submissions in hope of convincing Magistrate Donna Bakos to withdraw the charge.

The charge relates to Mr Pusey filming the graphic aftermath of the crash, including the bodies of Leading Senior Constable Lynette Taylor, Senior Constable Kevin King, Constable Josh Prestney and Constable Glen Humphris.

The officers were standing on the roadside after intercepting Mr Pusey for allegedly speeding when a truck veered into the emergency lane and killed them.

Mr Pusey survived as he had walked to nearby grassland to urinate.

He is also charged with driving at a dangerous speed, reckless conduct endangering life, destruction of evidence, perverting the course of justice, failing to remain at the scene after a drug test and failing to render assistance.
