Bikie boss Toby Mitchell has been ordered to undergo anger management counselling over two separate street fights but will have to wait several months before a magistrate decides his fate.
It comes as footage of Mitchell being knocked out by a homeless man and slipping in his slides was released by the court on Monday.
The Mongol president last week pleaded guilty to two counts of unlawful assault, which occurred just weeks apart in South Yarra and Southbank in October and November last year.
Mitchell admitted to assaulting an associate outside a popular cafe on Domain Rd near Melbourne’s Botanic Gardens on October 4 in front of “fearful” onlookers.
Defence barrister Damian Sheales had earlier argued the Sunday afternoon rumpus was “the most minor incident ever” during which the victim “didn’t even lose the beer he was holding”.
Security footage of the incident, which lasted less than a minute, shows Mitchell hitting the victim in the head multiple times before slipping in spilt drink and falling to the ground.
Mitchell was released on bail before being hauled back before the same magistrate weeks later on November 15 for a drunken melee with a “local street person”.
CCTV footage of the incident showed the burly bikie approaching the man who was sitting alone at Queensbridge Square about 3am.
Mitchell’s mates can be seen trying to hold him back as he aggressively throws punches at the man.
But the former champion kickboxer, who has survived being shot six times, ended up coming off second best when his victim jumped to his feet and landed a punch on Mitchell’s jaw, causing him to fall to the ground.
Mitchell’s associates ran to his aid and pulled him to his feet before dragging him away from the scene.
Mitchell was due to be sentenced on Monday after Magistrate John Bentley ordered he undergo a community correction order assessment last week.
But a spokesman for Corrections Victoria told the court Monday they need at least four weeks to conduct an extensive assessment of his suitability, to avoid the risk of “setting Mr Mitchell up to fail”.
Mr Bentley instead deferred his sentencing decision to September during which time Mitchell must undergo alcohol and anger management counselling.
Mitchell’s tough bail conditions, including a nightly curfew which ordered him to stay home every night over the holiday season, were relaxed.
Additionally, the top Mongol will now be allowed to hang with his club mates after a “non-association” condition was also removed.
Appearing via videolink from his lawyer’s office, Mitchell said he understood the magistrates’ orders.
He will return to court for sentence on September 6.
