Pusey complains he was ‘forced to smear faeces’ in his cell to receive attention from custodial staff

Porsche driver Richard Pusey’s “grandiose” and “elaborate” arguments have been shot down during his bail application at the Supreme Court.

Porsche driver Richard Pusey has been refused bail for the third time this year after claims his prison conditions were “deranging” were dismissed by the Supreme Court.

The former mortgage broker represented himself during a bail application at the Victorian Supreme Court on Thursday, arguing he should be released into the community because he was not receiving proper care while on remand in jail.

“Behind those prison walls … there is a holocaust of minds going on,” he said.

“When you put someone in a helpless and hopeless position, you’re never going to get an honest conviction.”

Pusey, 44, who has been on remand since February after he allegedly uploaded photos from the Eastern Freeway crash online, told the court his prison conditions were “deranging” and he was forced to smear faeces in his cell to receive attention from custodial staff.

He also said prison staff had not provided him with the correct court documents so he could prepare his case and that remand was like being a patient receiving anaesthetic after surgery had already been completed.

“Here I am today, pedalling a bicycle with no pedals,” he said.

But Justice Lesley Taylor dismissed the application, finding Pusey’s “grandiose” and “elaborate” arguments did not satisfy the exceptional circumstances hurdle required for bail.

She also found Pusey failed to demonstrate he did not pose an “unacceptable risk” of endangering the safety of the public or that he would not reoffend while on bail.

“It follows that bail must be refused,” Justice Taylor said.

Pusey was remanded after he was charged with several counts of using a carriage service to cause offence by uploading graphic images from the April 2020 crash in a Google review of a Porsche dealership and in a complaint to the Australian Financial Complaints Authority.

He allegedly took the photos after he was stopped by police for speeding in his Porsche when a passing truck driven by Mohinder Singh veered into the emergency lane and hit and killed four officers.

Pusey, who has twice been refused bail while he fights the charges, will appear at Sunshine Magistrates’ Court later this month where a decision will be handed down.
