Ousted bikie Toby Mitchell has continued his run of exemplary behaviour with a judge finding he had made “encouraging” progress in his court-mandated treatment programs.

The former Mongol boss fronted the County Court on Monday for judicial monitoring after he successfully overturned a two-month prison sentence for slapping a punter at an Echuca pub in November last year.

Mitchell was originally given a jail term after he pleaded guilty to striking the man during his 47th birthday celebrations but was resentenced to a one-year community correction order on appeal.

As part of his community sentence, Mitchell was ordered to take part in treatment programs for mental health issues, alcohol abuse and anger management with periodic monitoring by Judge George Georgiou to ensure compliance.

Judge Georgiou on Monday commended Mitchell, who beamed in via video link with a Scarface poster behind him, for not missing a single session since his last check-in four months ago.

“Once again, it is a positive report,” he said.

“You have complied with all of the obligations that have been placed on you by community corrections and indeed, ultimately, by this court.”

Given his progress, the judge said Mitchell would no longer require judicial monitoring but he needed to continue his treatment.

“Of course if you breach conditions of the order between now and its expiry date … you’ll have to come back before me and I will need to resentence you on the original offence,” he said.

Earlier this year, Judge Georgiou granted the former bikie boss’ appeal, ruling he could not be satisfied beyond reasonable doubt that Mitchell had struck his victim with a closed fist.

Mitchell was in Echuca with more than 100 bikie mates for his birthday bash when he slapped a patron at the American Hotel on November 28 last year.

CCTV footage showed Mitchell sitting with a woman at a table before he got into an argument with a punter.

Judge Georgiou accepted Mitchell had been provoked by the victim who was drunk and, without invite, had spent up to an hour hanging out with the bikie and his partner.

The legal battle came soon after Mitchell’s dramatic expulsion from the Mongols.

Soon after his jail term was thrown out, he made a cryptic online post about “walking away” from toxic scenarios and officially cut all online ties with the outlaw motorcycle gang.
