The mother of a violent murderer says she does not want to raise any child born as a result of the imprisoned killer being granted approval to have IVF behind bars.

It comes after Alicia Schiller had told authorities the child could live with her mother once it turned five.

Under Victorian laws, the child can be raised inside prison until they reached that age, but then should be cared for in the community.

Kathryn Footner, a lawyer for Schiller’s mother, on Thursday revealed to the Herald Sun that her client would not care for the infant if the IVF treatment was successful and her daughter fell pregnant.

There has been public outrage over the bombshell revelations that Schiller had been granted approval to leave her maximum-security prison to have IVF.

Schiller is serving a 16-year sentence for repeatedly stabbing and ultimately killing housemate and mother of three Tyrelle Evertsen-Mostert.

Tyrelle’s mother, Jo Evertsen-Mostert, said the decision to allow Schiller IVF was “ludicrous” and “disgusting”.

“It’s criminal that this animal could be allowed to have another child,” she said.

“This is a joke. How many more women are going to try the same?

“The government needs a massive overhaul of its stupidity.

“This has brought up so much pain. It’s unbearable.”

In another shocking development, Allan government MPs voted down a bill proposed by the Opposition to strip prisoners of the right to access IVF.

The Herald Sun this week revealed Schiller, who killed Tyrelle over $50, was approved to be released from the Dame Phyllis Frost Centre for IVF.

Tyrelle’s orphaned son Tobias Evertsen-Mostert on Thursday told the Herald Sun: “This whole situation just goes to show how little remorse she (Schiller) actually feels, it’s a slap in the face.”

Schiller had “caused damage to the whole family”, he added.

Opposition police spokesman Brad Battin launched an online petition calling on Victorians to pressure the Allan Government to “reverse this decision and respect the victim’s family”.

“The Allan Labor government has granted special leave for a convicted killer, who murdered her victim in the same house as the victim’s four-year-old child,” he said. “The convicted murderer wants to raise the child in prison until they are five years-old, before handing it to her mother to raise until she is released.

“It is time for the Allan Labor government to put victims first.”

Victorian Corrections Minister Enver Erdogan said he was wary of unintended consequences of banning IVF for prisoners.

“I think prisoners accessing medical treatment is important in terms of especially having a rehabilitative correctional system, so we don’t want any unintended consequences, especially in situations where people may have … previously had IVF treatment that may have complications later on while they in custody,” he said.

Mr Erdogan said he was awaiting advice from the Justice Department about distinguishing Schiller’s case from another in 2010 in which a prisoner in minimum security was allowed to continue IVF.

“I’m awaiting that advice, but that case, in relation to the IVF treatment in 2010, was clear that it is medical treatment that falls under Section 47 of the Corrections Act,” he said.

Premier Jacinta Allan said her thoughts were with the victim’s family, who “continue to grieve the loss of their loved one, (and) the loss of opportunities as a result of the crime that was committed”.

“I can understand the depth of feeling in this issue and advice is being sought,” she said.
