Deaths of missing campers a 'tragic accident' amid struggle for gun, knife: Defence

Former Jetstar pilot Greg Lynn admits to hiding and burning the bodies of high school sweethearts Russell Hill and Carol Clay but says their deaths were a "tragic accident" during separate struggles over a gun and a knife.

The trial for a former Jetstar pilot accused of murdering two campers has begun in the Supreme Court of Victoria on Tuesday.

Gregory Lynn has pleaded not guilty to the murders of Russell Hill, 74, and Carol Clay, 73, who vanished during a camping trip to the Wonnangatta Valley in Victoria’s alpine region in 2020.

Crown prosecutor Daniel Porceddu and defence barrister Dermot Dann KC will deliver their opening arguments today, summarising their cases and the evidence they expect to put before the jury.

Camper describes encounter with Mr Hill in days before deaths

Camper Blair Anson arrived at the Alpine National Park on March 11, 2020 to go deer hunting with friends.
Camping nearby was Mr Hill, at that time alone.
Mr Hill told the group he planned to camp there for a few nights.
"He introduced himself as Russell," Mr Anson said.
"He asked permission from me if he could fly his drone, I said that's not a problem with me."
Mr Anson said he assumed Mr Hill asked for permission because he knew it was illegal to fly drones in the national park.
"He was a knockabout sort of guy, he was friendly … we found him very approachable and friendly," he said.
Mr Hill wasn't a hunter, he said, and had an antenna attached to a branch to speak to his mates via a radio.
At one point, Mr Anson said he saw Mr Hill chopping up snowgum and, aware that it was illegal, asked him "if he cared about Parks (Victoria)".
"I don't give a f**k," Mr Hill replied, the court heard.
"Just to see an older man swear like that … it stuck in my head," Mr Anson said.
A few days later, the older gent told Mr Anson and his mates he was leaving as bad weather was on its way.
Later, upon learning of Mr Hill's disappearance, Mr Anson agreed with defence barrister Mr Dann he had been concerned that he may have killed himself.
"It would be because he worked up there and I assumed someone who worked up there wouldn't get lost."
It's the prosecution case that Mr Hill returned to his home in Drouin before picking up Mrs Clay from her Pakenham house on March 19 to set off for their camping trip in the Wonnangatta Valley.

Mr Dower has been excused and the jury has been given a short break before the next witness is called to give evidence.

Mr Dann, in cross-examination, showed Mr Dower a map found in the late Mr Hill's vehicle that indicated where deer hunting was and wasn't permitted.
The defence barrister asked if someone wished to police others' hunting, they "can use a map such as this?"
Mr Dower agreed that the public had access to the map.

The Alpine National Park was a "very popular area" for people visiting for recreational 4WDing, deer hunting, fishing, bushwalking, and birdwatching.
Mr Dower said there was no phone reception in the Wonnangatta Valley, and that roads were closed in the area in March 2020 as teams responded to bushfires in the alpine region.
He said there were road closures towards the Myrtleford exit, including on the Wonnangatta Track, north of the Wonnangatta River.
It's this track where Mr Lynn attempted to exit via after he had allegedly murdered Mr Hill and Mrs Clay.
The road was closed for public safety due to fire operations as Parks Victoria worked to clear tracks and hazards.
Mr Dower marked maps, showing the jury the location of Bucks Camp, also known as Dry River Camp, and where a nearby homestead's ruins and historic cemetery is located.
He's also noted the Wonnangatta Track, which runs into the High Plains Rd, "our most popular access route" between Wonnangatta Valley towards Dargo.

Park ranger first witness called to give evidence

A phone ringing from the public gallery briefly disrupted proceedings, with Justice Croucher asking members of the public to turn their phones off while in court.
The first witness, Michael Dower, has now entered the witness box.
Mr Dower is the area chief ranger for Parks Victoria, responsible for Alpine National Park.
He leads a team of rangers that manage 350,000 hectares of remote mountain, including the Wonnangatta Valley.

Trial resumes after technical glitch

Justice Michael Croucher apologised to the jury after a technical glitch caused a delay in resuming the case.
His Honour said the jury would get an instruction on how to use their iPads where they would see the exhibits.
Some jurors may to find using the iPads "easy peasy lemon squeezy" while others might find it to be "like trying to split the atom", he said.

There's been a short delay in the trial resuming after lunch. We'll post here as soon as the hearing continues.

Defence openings have finished and the jury has been excused for lunch.
Witnesses will be called to give evidence when court resumes at 2pm.

Burning bodies made accused 'physically sick': Defence

Mr Dann said according to Mr Lynn's account to police, he "knew his life as he knew it would be screwed and he tries to make this disaster somehow go away".
The barrister agreed that the pilot acted in a "completely selfish, even callous way", where he engaged in some "terrible actions".
He confirmed his client unloaded the bodies of Mr Hill and Mrs Clay at Union Spur Track, that he returned home then drove back to the site and burnt the bodies, which made him "physically sick".
Mr Dann said the jury would see Mr Lynn telling the police his account of what occured.
"I'm innocent of murder," the accused told officers.
"I haven't behaved well, I've made some poor decisions, but murder as I understand it, I'm innocent of."
