An asylum seeker who has previously been accused of running a child prostitution ring allegedly breached his sex offender reporting obligations by using TikTok to message children.

A convicted child sex offender accused of contacting children while in immigration detention will remain locked up after losing a second shot at freedom.

Emran Dad, who was released from indefinite detention following a High Court ruling in November, was refused bail at the Dandenong Magistrates’ Court for a second time on Monday over allegations he repeatedly breached his sex offender reporting obligations.

It’s alleged the 33-year-old criminal asylum seeker made contact with underage girls on TikTok and created an Instagram, Bigo and email account without informing police.

The fresh bail application was made following consent by Dad to comply with a prohibition order which meant if he was released back into the community he would not communicate with females under the age of 18 or use social media.

However police submitted to the court that even with the prohibition order, Dad would be a “significant risk” of reoffending given his priors, including his lack of compliance with previous court orders.

Dad is a registered sex offender who police allege formerly headed a prostitution ring which preyed on children in state care.

The Afghan has numerous child sex offence convictions including inducing a child into sex work and sexual penetration of a child under 16.

Court documents allege Dad was following several underage females on TikTok and communicating with a 15-year-old girl on the platform since September when he was still in detention.

It’s alleged he did not report these child contacts to police as per his reporting obligations.

Dad’s brother gave evidence in support of his release, saying he and their mother would make sure Dad did not have access to a smartphone or social media and that they’d immediately report any future breaches to police.

The brother told the court they were not previously aware of restrictions on Dad’s social media use.

“If he does anything wrong, we will be the first to inform police,” the brother told the court.

Magistrate Fran Medina granted the prohibition order but refused bail, saying Dad posed an unacceptable risk of reoffending which endangered the safety and welfare of the community, particularly young, vulnerable children.

Dad is charged with 13 counts of failing to comply with his sex offender reporting obligations and one count of trespass over an incident at Services Australia in Dandenong on November 24.

He had been in indefinite immigration detention since 2018 until he and 147 other detainees were released after the High Court ruled the practice was unlawful.

More than half a dozen detainees have been arrested since their release, sparking political crisis for the Albanese government.

Dad was remanded in custody to reappear at Dandenong Magistrates’ Court on February 13.
