Child killer Robert Farquharson is being blamed for the untimely death of his former wife a decade after he was sentenced to life in prison for murdering their three sons.
Cindy Gambino died unexpectedly last year (2022) at just 50 years old, 17 years after her boys drowned when Farquharson deliberately drove into a dam as they returned home from a Father’s Day access visit.
Her widower, Stephen Moules, and their two children are now suing Farquharson, claiming she died as a result of his actions in the 2005 crash.
In one of the most shocking crimes the state has ever seen, Farquharson swam to shore and left his boys to die, telling passers by not to try and save his kids because they were “already gone”, instead asking for a ride to Ms Gambino’s house.
Ms Gambino’s family earlier confirmed that she passed away from a “medical episode” at home in May despite “valiant attempts” to revive her by Mr Moules and paramedics.
A County Court writ states that Ms Gambino’s death was “as a consequence of injuries she sustained” from the Princes Highway crash that claimed the lives of her three boys Jai, Tyler and Bailey at Winchelsea on September 4, 2005.
Mr Moules and sons Hezekiah and Isaiah, aged 16 and 13, in documents state that their “loss of dependency was caused by the negligence of (Farquharson) in the driving, management and control of his motor vehicle”.
According to the writ lodged on December 13, the killer dad’s negligence included deliberately causing the crash, driving into the dam, dangerous and careless driving, excessive speeding, failing to stop or slow the car or keep a proper lookout, failing to apply brakes or steer to avoid the water, and not complying with the Road Safety Act.
The civil case is expected to be listed for a judge-alone trial at a later date.
Farquharson was found guilty in a 2010 retrial of murdering sons Jai, 10, Tyler, 7, and Bailey, 2.
A jury found he had committed the heinous crime in an act of revenge against Ms Gambino for moving on with her new partner, Mr Moules.
Farquharson was sentenced to life behind bars with a 33-year minimum.
In a statement following Ms Gambino’s death, her family remembered her as a “warrior for justice” who gained new hope when she and Mr Moules welcomed two sons into the world after the unfathomable tragedy.
