The model ex-girlfriend of Ultra Tune boss Sean Buckley will testify against him in court as he plans to fight allegations he stalked and assaulted her.

Jennifer Cruz Cole allegedly recorded Mr Buckley — the father of her child — hitting and choking her amid threats to hurt her when they were staying at Melbourne’s Crown casino.

He is also accused of hiring two men to follow Ms Cole, and renting the Melbourne apartment next door to her where cameras were installed to keep her under surveillance.

Mr Buckley, 61, is facing 12 charges, including stalking, assault, recklessly causing injury, installing an optical surveillance device and maintaining a listening device.

The alleged offending spanned from April 27 to December 2, 2020.

Mr Buckley’s barrister Remy van de Wiel, QC, on Monday was granted permission to cross examine Ms Cole in Melbourne Magistrates Court.

She was one of a handful of witnesses who will be called to give evidence in a seven-day contested hearing in February.

Mr van de Wiel said questions would arise around if the recording Ms Cole took is accurate.

“There is a real issue with the integrity of the recording,” Mr van de Wiel said.

Co-accused Wade D’Andrea, 40, — one of the men allegedly hired by Mr Buckley to stalk Ms Cole — also plans to fight his charges at the contested hearing.

An earlier court heard how Ms Cole caught Mr D’Andrea retrieving listening devices he had planted inside her apartment.

A magistrate will determine following the contested hearing whether there is sufficient evidence to commit Mr Buckley and Mr D’Andrea to stand trial.
