Axed Labor MP Will Fowles will face no further police action over allegations he sexually assaulted a colleague.

Mr Fowles told the Herald Sun he learnt of the news on Tuesday.

He will return to parliament next week.

“I acknowledge the confirmation from Victoria Police that they have closed the investigation and will not proceed with any charges,” he said.

“I have always maintained my innocence in the matter, and I am looking forward to continuing my work for my constituents in Parliament.”

But Jacinta Allan has ruled out Mr Fowles returning to the ALP.

The Premier said despite the decision, the Ringwood MP would not be welcomed back.

“The wellbeing of staff and their right to a safe workplace is not negotiable and we will always act on any allegations of a serious nature,” she said.

“The Member for Ringwood was asked to resign from the Parliamentary Labor Party in August last year.

“He will not return.

“The complainant will continue to be supported and their privacy must be respected at this time.”

In a statement Victoria Police said an investigation into allegations that were levelled at Mr Fowles had concluded.

“A 45-year-old Ringwood man was interviewed in October 2023 and subsequently released pending further inquiries,” it said.

“While a rigorous and methodical investigation has been conducted into the matter, in conjunction with senior legal advice, it has been determined that charges will not be laid at this time.

“Any further information provided to police will be thoroughly assessed.

“All parties involved in this matter have today been advised of this decision and we will continue to provide the appropriate support where required.

“As the matter is now considered closed, we will not be commenting further at this time.”

The conclusion of the investigation paves the way for Mr Fowles to return to parliament when it resumes on Tuesday.

He had refused to attend pending the investigation.

The Ringwood MP was accused of a “serious assault” of a colleague at a city hotel after drinking at the parliamentary members bar in August.

It prompted a two-day investigation by the Premier’s private office which led to a formal referral being made to Victoria Police.

Several weeks later detectives from the sexual crimes squad confirmed there were formally investigating the incident.

Mr Fowles, who has vehemently denied any wrongdoing, was forced to resign from the parliamentary Labor Party.
