House, car, bikes: Alleged Hells Angel Scott Michael Kristian Smith banned from dealing with his own property as legal war wages

A barber and alleged outlaw gang member has lost control of his property – including his motorcycles – by court order.

A barber who, prosecutors allege, is a high-ranking member of one of the world’s most notorious outlaw bikie gangs has had his assets frozen ahead of his drug case.

The Advertiser can reveal the District Court has handed down orders banning alleged Hells Angel Scott Michael Kristian Smith from dealing, in any way, with his own property.

Under the terms of the orders, neither Mr Smith nor his Gawler South business, The Sweet Fade Pty Ltd – may “dispose of” or “otherwise deal with” his six-room, $405,000 villa, built at Munno Para West in 2008.

Nor may he make financial use of his grey 2023 Ford ute or either of his two black Harley Davidson motorcycles – one made in 2015, the other in 2014 with the registration number “Bigcrip”.

Mr Smith, 38, of Munno Para West, has yet to plead to two counts of trafficking in a commercial quantity, four counts of a large commercial quantity and two counts of basic trafficking in a controlled drug.

Prosecutors have alleged he is one of the highest-ranking members of the outlaw motorcycle gang, and was arrested in a Serious and Organised Crime Branch investigation.

They have alleged detectives seized about 3kg of methamphetamine, 100g of cocaine, two cars and a motorcycle during a series of raids.

Mr Smith was granted $30,000 bail by the Adelaide Magistrates Court, and prosecutors unsuccessfully challenged that decision in the Supreme Court.

During those hearings, defence counsel claimed Mr Smith was not receiving appropriate medical care in custody, was bleeding from the bowel and may have untreatable cancer.

They further claimed his business partner was “struggling” to run the shop in his absence because she was a trained hairdresser while Mr Smith dealt with accounting matters.

In court papers, released to The Advertiser by the court, the Office of the Director of Public Prosecutions makes two broad applications.

The first asks Mr Smith’s assets be frozen while he faces prosecution for the alleged offending.

The second asks that, should he be convicted, the frozen assets be deemed “criminal assets” and forfeited to the state of SA.

They ask those orders also protect the rights of the Commonwealth Bank – from which the house is mortgaged – and Angle Auto Finance Pty Ltd regarding the assets.

Judge Joanne Deuter agreed to make the first of the orders, and adjourned the matter for 12-18 months for consideration of the second order once the criminal case has concluded.
