A magistrate has granted bail to a man alleged to be one of SA’s most senior Hell Angels bikies – before prosecutors called for Supreme Court review.

The state’s Chief Magistrate has granted bail for an alleged top-ranking Hells Angel bikie who a court heard has untreatable cancer – but he is still in custody ahead of a review in the Supreme Court by prosecutors.

In a bail hearing in the Adelaide Magistrates Court, Judge Mary-Louise Hribal granted Scott Michael Kristian Smith home detention bail following a $30,000 cash surety being lodged.

But as Judge Hribal concluded detailing the terms of his bail, the police prosecutor stood and called for a Supreme Court review hearing over the bail decision.

John Lister, for the 38-year-old, explained to his client he would not be getting out of police custody on Tuesday and needed to wait for the outcome of the review by a Supreme Court judge.

Mr Smith, of Munno Para West, has yet to enter a plea to two counts of trafficking in a commercial quantity, four counts of a large commercial quantity and two counts of basic trafficking in a controlled drug.

During the first hearing of the bail application, the court heard Mr Smith was not receiving appropriate medical care in custody, was bleeding from the bowel and may have untreatable cancer.

Police prosecution alleged during that hearing Mr Smith – arrested as part of a Serious and Organised Crime Branch investigation in the northern suburbs – is one of the highest-ranking members of the Hells Angels outlaw motorcycle gang.

It was alleged the 38-year-old was supplying methamphetamine from his Munno Para West “safe house” to alleged Hells Angels initiate Bradley Horlor, 28.

During Tuesday’s hearing, Mr Lister said multiple members of Mr Smith’s family had attended court in support of his bail application including his 15-year-old son, brother, father, friend of 35 years and business partner.

The court heard his business partner was “struggling” to run the business because she was a trained hairdresser and Mr Smith dealt with the business and accounting matters.

Mr Lister also submitted he was a “hands on” father to his son, and the teen’s mother was struggling in his absence with day-to-day tasks.

The court also heard Mr Smith had a “very close family” and he wanted to be able to communicate with his uncle, who was terminally ill and likely to die “very soon”.

Mr Lister has previously told the court Mr Smith remained “very concerned” about how his health was being managed because he was “passing large amounts of blood through his bowel”.

“He is not receiving any attention, or the appropriate attention for that condition,” Mr Lister said.

The court heard following his arrest Mr Smith was rushed to hospital, and a recent colonoscopy appointment had been cancelled over concerns of a “potential security breach”.

Mr Lister said Mr Smith was told by a doctor the “worst-case scenario” for his symptoms was “bowel cancer” that could have spread and was “untreatable”.

Prosecution have 72 hours to bring the matter before the Supreme Court for review.
