THE police shooting of two people dressed as comic book super villains at an erotic party in a King St nightclub on Saturday morning is now being investigated by the Independent Broad-based Anti-corruption Commission (IBAC).

IBAC released a statement on Monday night saying it is examining the shooting.

The IBAC Commissioner Stephen O’Bryan QC has spoken to the acting Chief Commissioner of Victoria Police, Shane Patton, about the investigation.

Dale Ewins, 35, and Zita Sukys, 37, were shot at Inflation Nightclub shortly after 3am on Saturday when police stormed the club following a report of a man with a gun.

Mr Ewins, who was dressed as the Joker, did have a toy gun in his possession during the evening.

It is unclear if he was holding it when he was shot in the chest, with some witnesses saying he wasn’t and police claiming afterwards that he was.

Ms Sukys was shot in the leg. It is understood the couple were in a compromising position with each other at the time police fired the shots.

“Under its standing own motion powers concerning deaths or serious injury resulting from contact with police, IBAC is reviewing actions taken to date (including information provided by nightclub staff, initial police reports, police and witness statements, and relevant CCTV footage and other evidence),” an IBAC spokesman said.

“IBAC has confirmed with Victoria Police that arrangements are in place to deal with any potential or perceived conflicts of interest in the initial police investigation, including as a result of recent civil action (unrelated to the latest incident) taken by the owner of the nightclub.

“In assessing the matter, IBAC will oversight Victoria Police’s investigation being conducted by the Armed Crime Squad and Professional Standards Command, and determine further action required.”

A Victoria Police spokeswoman said the force would “provide complete assistance to IBAC with its examination”.
