A chicken abattoir worker has walked free from court after punching one man, spitting on another and threatening staff at a Gold Coast fast food restaurant.

Dylan Chomel, 29, pleaded guilty in the Southport Magistrates Court to two counts of common assault and one count each of public nuisance, wilful damage and obstructing police.

On September 25 last year, Chomel was with a group of people at KFC Pimpama when he began arguing with counter staff, the court was told.

The 29-year-old father punched a patron with a closed fist before he rushed towards the counter, jumped on it and kicked two computer units, causing damage.

Chomel then spat on a second person, which landed on the victim’s shirt, before he was restrained.

His “disorderly and violent” outburst caused a family dining in the restaurant to leave in distress, the court was told.

When police arrived at the scene, Chomel became aggressive and tried to break free as he was being searched.

The 29-year-old’s legal representative said his client had been drinking excessively that day and had poor memory of the incident.

Chomel was sentenced to two months’ imprisonment, wholly suspended for six months, and fined $300.

Convictions were recorded.
