An alleged Nomads bikie and accused bikie associate waited in a Gold Coast laneway and attacked a group of four, including stomping on one man’s head, it has been alleged in court.

An alleged Nomads bikie and accused bikie associate waited in a Burleigh Heads laneway and attacked a group of four, including stomping on one man’s head, it has been alleged in court.

Scott Andrew Pont however claimed to have given up his ties and membership with the outlaw motorcycle gang since 2017.

Pont, 31, and co-accused Luke Anthony Schmerse, 30, appeared in Southport Magistrates Court on Thursday charged with one count each of assault occasioning bodily harm and affray and four counts of assault.

The court heard Pont and Schmerse allegedly positioned themselves in a laneway near the Pink Monkey Bar and Grill about 11pm on July 3.

It is alleged four people not known to the pair walked through the alleyway.

One allegedly recommended the defendants not go to a nearby licenced venue.

Pont and Schmerse allegedly responded: “What did you say to us?”

That is when Pont and Schmerse allegedly attacked the group of three men and one woman.

The court was told during the fight Pont allegedly put one complainant in a choke hold and told them to “tap out”.

It is alleged when the woman tried to pull Schmerse off one of the complainants, Pont pushed her, causing her to fall over.

The court was also told Pont stomped on the head of another of the victims, causing his head to hit the pavement.

It is alleged both Pont and Schmerse punched and kicked the complainants a number of times during the incident.

Magistrate Kerry Magee denied Pont bail.

“This is an extremely serious and unprovoked attacked on people outside a licenced premises late in the evening,” she said.

“(Pont) has an extremely serious history of offences of violence.”

Magistrate Magee granted Schmerse bail on conditions he abide by a curfew between 8pm and 6am, report to police every Monday, not contact witnesses and not go within 100m of the Pink Monkey Bar and Grill.

Pont’s lawyer Andrew Owens, of Owens & Associates, said his client not longer had an association with the bikie gang.

“In 2017 there was a disassociation with those people,” he said.

“It is potential that information is dated and not relevant to consideration today.”

Mr Owens said Pont had an “appalling criminal history” but had not offended since 2016.

He told the court Pont was sentenced to prison in 2017 for a wounding offence and upon release completed two years of parole without a breach.

Mr Owens said Pont since completing parole in 2019, Pont had not been charged with an offence.

Magistrate Magee adjourned Pont and Schmerse’s matters to the Coolangatta Magistrates Court on August 29.
